Terms

1About these terms

These terms cover the Elk Pegasus website and the swimwear we make to order. Elk Pegasus is a small studio in Ideguchi, Nobeoka. By using the site you agree to the terms below; by placing a commission you also agree to the written quotation we send you, which sets out the design, fabric, price and timeline for your piece.

2Seller information

Business name: Elk Pegasus. Address: 2-8-1 Ideguchimachi, Nobeoka, Miyazaki 882-0831, Japan. Telephone: +81 982-68-5935. Email: info@elkpegasus.com. The name of the person responsible for operations is disclosed without delay on written request.

Prices are shown in Japanese yen on the Products page and the written quotation states how consumption tax is treated. Postage for a finished garment or a toile, and any bank transfer fee, are charged separately and quoted before you pay. We accept bank transfer and major credit cards.

3Photographs on this site

The photographs on this site are illustrative images of swimwear, fabric and the seaside. Unless a caption says so, they are not a record of a particular commission, and the colours on your screen will differ from the real fabric. Ask for a swatch or look at the fabrics in person before you choose.

4Our content

The text, layout and images published here belong to Elk Pegasus or are used with permission. You may read and print pages for your own use. Copying them for another website or for commercial purposes needs our written permission.

5From enquiry to commission

A commission begins with a message. We reply by email and suggest a first appointment at the studio or a video consultation. After the twelve measurements are agreed we send a written quotation. Work starts when you have accepted it and the fifty percent deposit has arrived, and the balance is due before the finished piece is posted or collected.

Typical timelines are three to four weeks for the ready-to-order designs and four to six weeks for a full bespoke commission, plus about a week of postage each way for clients who fit remotely. These are estimates; the quotation gives the date we expect to keep.

6Measurements you provide

A garment is only as accurate as the measurements it is cut from. At the studio we take them ourselves. For remote commissions you take them with our guide and we go through them together on a video call, and the toile fitting is there to catch anything that was missed. Please tell us about any change in your size before the final fabric is cut.

7Changes and cancellation

You may change the design or cancel before the final fabric is cut. If you cancel at that point, we return the deposit less the cost of the toile, any fabric already ordered for you and the time already spent on the pattern. Once the final fabric has been cut, a made-to-measure piece cannot be cancelled or returned because it cannot be sold to anyone else.

The cooling-off system under the Act on Specified Commercial Transactions does not apply to sales by mail order, so the rules in this section apply instead.

8Fit, alterations and defects

Each commission includes one free alteration within six weeks of collection or delivery. If a garment arrives with a defect, or is clearly different from the quotation, tell us within seven days of receiving it and send a photograph. We will repair it, remake it or refund the price, whichever is fair for the problem. Your rights under Japanese consumer law are not reduced by anything written here.

9Care and use

Swimwear lasts longer when it is rinsed after use and dried flat, as described in our care article. We cannot accept responsibility for damage caused by hot tubs, strong chemicals, rough surfaces or ignoring the care instructions that come with the piece.

10Articles and general information

The articles and answers on this site are general guidance on fabric, fit and care. They are not a promise about how a particular piece will look or feel on a particular person. Opening hours, prices and availability can change; the price that applies is the one in your written quotation.

11Liability

To the extent the law allows, Elk Pegasus is not liable for indirect losses that result from using this website. Nothing here limits liability that cannot be limited by law, including liability for intentional or grossly negligent acts.

12Personal information

How we handle the information you send us is described in the privacy policy, which forms part of these terms.

13Changes to these terms

We may revise the terms when the business or the law changes. The version on this page is the one in force, and a commission is governed by the version that applied on the day you accepted the quotation.

14Governing law

These terms are governed by Japanese law. If a dispute cannot be settled by talking it through by email, the Miyazaki District Court, Nobeoka Branch, has jurisdiction in the first instance by agreement, without affecting any right a consumer has to bring a case elsewhere.
